There are 3 degrees to sexual abuse crimes. Here are each of them and their legal definitions:
“Sexual abuse” generally involves sexual contact, which is usually touching an intimate part of another person, without that person’s consent. In Oregon, minors - - those under 18 year old, cannot “consent” as a matter of law.
Sexual Abuse in the Third Degree
- When an individual subjects another person to sexual contact and does not receive consent prior to the contact, this is sexual assault.
- If the victim in question is incapable of consent by reason of being under 18 years of age, this is sexual assault.
- If a dangerous substance is intentionally propelled towards the victim for the purpose of arousing or gratifying the sexual desire of the person or another person without consent, this is sexual assault.
These three crimes fall into the category of Sexual Abuse in the Third Degree, which is a Class A Misdemeanor, meaning the maximum penalty is 364 days in jail and a $6,250 fine.
Sexual Abuse in the Second Degree
Sexual Abuse in the Second Degree crimes are Class C “felonies,” not misdemeanors, meaning that the maximum penalty is 5 years in prison and a $125,0000 fine.

- A person commits a variation of sexual abuse in the third degree and is 21 years of age or older, and at any time before the offense takes place, the person was the victim’s coach, as defined in Oregon law.
Sexual Abuse in the First Degree
The most serious of the Sexual Abuse charges are catagorized as Sexual Abuse in the First Degree. Sexual abuse in the First Degree is a Class B felony, meaning the maximum penalty is 10 years in prison and a $250,000 fine. Also, this is a Ballot Measure 11 offense - - meaning, if convicted, the court must impose a mandatory minimum term in prison, notwithstanding very few exceptions. A person commits the crime of Sexual Abuse in the First Degree when:
- The person subjects another person to sexual contact and:
- The victim is less than 14 years of age; or
- The victim is subjected to forcible compulsion by the assailant; or
- The victim is incapable of consent by reason of being mentally defective, mentally incapacitated or physically helpless, or
- The assailant intentionally causes a person under 18 years of age to interact inappropriately with the sexual organs of an animal for the purpose of arousing or gratifying their sexual nature.
